Islamabad February 23 2023: During the hearing of suo motu notice regarding delay in calling elections for Punjab and KP provincial assemblies, Justice Mansoor Ali Shah, present in the bench, raised the question that the court should also see that the term of the assemblies in the constitution is five years and the people have elected their representatives for five years.
He said that the court also has to see whether the Chief Minister dissolved the assembly while staying within the constitution or at the behest of some political figures.
He said that “if the court comes to the conclusion during the hearing that the constitutional requirements for dissolving the assembly have not been fulfilled, then these assemblies can be restored.”
The head of the bench Justice Umar Atta Bandial said that Article 224 says that elections will be held in 90 days.
He said that “time is passing quickly and the case was pending in the High Court but no decision was being taken.” He said that “the court will not tolerate any violation of the Constitution.”
On this occasion, Justice Athar Manullah said that the first question before the court will be whether the assembly has been dissolved under the constitution or not.
