Islamabad July 1 2022: Justice Ejaz-ul-Haq remarked that the judge who has given the dissenting note has also agreed on one point, the verdict said that out of those who got 197 votes, 25 votes have been removed.
Justice Ijaz-ul-Ahsan should be elected for the post of Chief Minister after July 17. Pervez Elahi said that we do not recognize Hamza Shahbaz.
The Chief Justice said, “Then we decide under the law, who has to be harmed, let it happen, tell those who are speaking in your ear to sit down.”
Parvez Elahi asked the court to order the two political parties to sit down and decide. Justice Jamal Chan Mandokhel said that in a democracy there is only dialogue
Hamza Shahbaz said that the Supreme Court is respected, the system should continue to function, he did not want to repeat what happened in the past. He said that the attack on the Deputy Speaker was shameful.
During the hearing, Hamza Shahbaz said that no one is indispensable for the system, let the election be held today, we also have people who wanted to go on Hajj but did not go, let the Supreme Court election be held.
Hamza Shahbaz said that if anyone had a majority after July 17, they would bring distrust. Justice Ijaz-ul-Ahsan said that today’s day has passed, we give decision after consultation. Sit down and work things out.
Hamza Shahbaz said that whatever happened in three months, the swearing in was delayed, I do not want to misrepresent that we should reach a consensus.
Hamza Shahbaz said that elections can be held till 12 o’clock tonight.
“We don’t have to wait until July 17,” the chief justice said.
Pervez Elahi said that if Hamza Shahbaz wants to stay till July 17, he should decide his authority, he should remain Chief Minister till July 17 but members should not be harassed. Justice Ejaz-ul-Hassan said that the courts are open if there are roundups.
“We request that as many members as possible be allowed to vote,” Awan said.
Chief Justice of Pakistan Justice Umar Ata Bandial said that this is not the case in your petition, we have read your petition, basically you do not believe that the decision was in your favor, to which Babar Awan said. That in principle we accept this decision.
The Chief Justice said that in the decision, four judges of the Lahore High Court have given today and one judge has given the date of tomorrow. Do you agree with the date of tomorrow?
Justice Ejaz-ul-Haq said that the members who have been called can reach in 24 and 48 hours.
Justice Ijaz-ul-Ahsan said that the other side said that they got 197 votes, the court said that whoever gets majority in the second poll will be elected.
The Lahore High Court had ordered the counting of these 25 votes. The court has ordered the counting of the first votes.
Justice Ijaz-ul-Ahsan remarked that you say that some of your servants are not available. ۔
Justice Ijaz-ul-Ahsan further remarked that the High Court has said that 25 out of 197 should be expelled. After getting 25 votes, the election of Hamza Shahbaz is not valid.
A simple majority of 186 is not required in the second round of elections. You are of the opinion that our members are abroad.
Babar Awan took the position that I am not saying that the members should be waited for, there should be a suitable time so that more members can participate in the voting.
The Chief Justice said that you accept that the decision of the Lahore High Court is in your favor.
Justice Ijaz-ul-Ahsan asked how many hours it would take for the members of the Punjab Assembly to reach the Provincial Assembly.
The Chief Justice said that the date of voting in the dissenting note is tomorrow, are you ready to vote tomorrow? He said members within the country could arrive in a day.
During the hearing, the PTI sought seven days for the re-election process.
Justice Ijaz-ul-Ahsan remarked that it is not appropriate to give seven days time, it will not take more than 24 hours for your members to reach the assembly.
Babar Awan said that the notification of our members was not issued by the Election Commission. The Chief Justice asked, “Do you want Punjab to remain without a Chief Minister for seven days?”
Justice Ijaz-ul-Ahsan said that what is written in the constitution that if the Chief Minister is not available then who will run the province, when the election of the Chief Minister was held 63A was not clear.
Babar Awan said that he had ten days in his mind but he has asked the court for seven days.
Justice Jamal Mandokhel said that they should first complete the matter at the appropriate time and then they would hear the second point.
Justice Ijaz-ul-Ahsan said that the governor can ask the legally elected chief minister to continue his work, when there is no chief minister then the cabinet will not be present.
The Chief Justice said that the High Court wanted the government to remain in power in the province. The caretaker Chief Minister can be when the election is taking place, the PTI has to prove its majority, Hamza Shahbaz got 25 votes.
Justice Ijaz-ul-Ahsan said that out of 25, how many PTI members are left.
On this occasion, PTI lawyer Faisal Chaudhry said that by getting 25 votes, our members become 169.
On which Justice Ijaz-ul-Ahsan remarked that it means you do not have a majority, no one in the House has a majority.
During the hearing, the Chief Justice said that it would be unconstitutional for the governor to run the affairs of the province. On July 17, the people have to vote for 20 seats. How can the province be prevented from functioning till the by-elections?
Democracy can be better if the people decide for themselves. Giving the governor the power to run the province would be unconstitutional.
The Chief Justice remarked that under the constitution only elected representatives can run the province, we give you half an hour to shake your head and think.
Justice Ijaz-ul-Ahsan said that the caretaker government can be formed only after the dissolution of the assembly.
