Islamabad May 6 2024: The Supreme Court has suspended the decisions of the Election Commission and Peshawar High Court regarding specific seats of PTI. The request of the Sunni Ittehad Council has been approved for hearing.
It should be noted that the five-member larger bench of the Peshawar High Court had said in its decision on March 14 that the decision of the Election Commission to distribute certain seats is in accordance with Article 51 of the Constitution of Pakistan.
The ruling said that a political party participating in the elections has the right to certain seats, but if that party does not win a single seat in these general elections, it is not eligible for certain seats.
The court in its judgment further said that the argument that the reserved seats cannot be given to other political parties in the House is unconstitutional and the Election Commission distributed the reserved seats in a constitutional manner.
The court said that the Sunni Unity Council is not entitled to reserved seats for women and the list of reserved seats cannot be submitted after the prescribed time, hence the petition is dismissed.
The Peshawar High Court upheld the decision of the Election Commission regarding the allocation of seats to the Sunni Ittehad Council.
